Florida ABLE (to be called ABLE United) is scheduled to launch in June, 2016. A lot has occurred since we last posted on this subject earlier in the year. We have Policy adopted by Social Security in the form of a new POM, SI 01130.70. We have the point person for ABLE in Florida, Will Thompson with the Florida Prepaid College Board, as a guest speaker at the Elder Law Section’s full day CLE on Special Needs Trusts in Orlando in June. I will also be covering ABLE as well as the Disabled Military Child Protection Act and our upcoming Elder and Disability Law Forum on May 26, 2016. The Act allows a veteran parent to direct their Survivor Benefits Plan into a Special Needs Trust for a dependent child and thus not impact the child’s benefits such as Supplemental Security Income or Medicaid.
